Terms of Service — Colorshade Graphics, Nairobi Kenya

Terms of
Service

The working agreement behind every order — clear, fair, and written in plain language.

Effective Date: To be confirmed at launch

These Terms of Service govern every quotation, order and service provided by Colorshade Graphics ("we", "us") of Printers Center Building, 3rd Floor, Kirinyaga Road, Nairobi, to any customer ("you"), within the Republic of Kenya and for orders shipped elsewhere.

1. Quotations & Orders

1.1. Prices published on this website are indicative and current at the time of publication; the binding price for any job is the written quotation we issue for it (via WhatsApp, email or invoice).
1.2. Quotations are valid for seven (7) days unless stated otherwise. Material costs (paper, garments, blanks) fluctuate, so expired quotations are re-confirmed before production.
1.3. An order is confirmed once you approve the quotation and the agreed payment or deposit is received.

2. Artwork & Proof Approval

2.1. Every custom job receives a digital proof before production. Production begins only after your approval of that proof.
2.2. You are responsible for checking the proof — names, phone numbers, dates, spellings, colors and layout. Errors present in an approved proof and reproduced in the final product are not eligible for a free reprint.
2.3. Errors made by us against an approved proof are corrected or reprinted at our cost.
2.4. Artwork you supply must be yours to use. You confirm you own or are licensed to reproduce any logos, images, or text you send us; Colorshade is not liable for third-party intellectual-property claims arising from customer-supplied artwork.
2.5. Layouts and design files prepared by our designers remain our property unless a design-buyout is agreed; we may decline to release editable source files.

3. Color & Production Tolerance

3.1. Printed and engraved output can vary slightly from what you see on a screen, and between production runs, due to materials, coatings and calibration. Minor tonal variation is a normal industry tolerance and is not a defect.
3.2. If exact brand-color matching is critical, supply Pantone/CMYK values with your artwork and request a physical sample before the full run.
3.3. For bulk runs, industry-standard quantity tolerance of ±2% of ordered pieces may apply on production-line items.

4. Customer-Supplied Items

4.1. We can print or engrave on garments, mugs, equipment and other items you supply. Because we cannot guarantee the behaviour of third-party materials and coatings, branding customer-supplied items is undertaken at the owner's risk.
4.2. Where feasible we test on one piece first and share the result before continuing the batch.
4.3. We are not liable for latent defects in customer-supplied items (weak fabric, damaged coatings, prior repairs) revealed by the branding process.

5. Turnaround & Delivery

5.1. Standard turnaround is 24–48 hours for small custom jobs and 3–5 business days for bulk campaigns and apparel, counted from proof approval — not from first contact.
5.2. Agreed deadlines assume timely proof approval and payment; delays on either shift the schedule accordingly.
5.3. Countrywide delivery is by third-party courier. Risk in the goods passes to you on handover to the courier; we will assist in tracing any delayed consignment.
5.4. Orders not collected within thirty (30) days of completion notice may attract storage charges or be disposed of after reasonable notice.

6. On-Site Laser Deployments

6.1. For on-site asset tagging and engraving, travel within Nairobi is free; deployments outside Nairobi attract a travel fee (currently KSh 5,000) stated in your quotation.
6.2. You must provide safe access to the site, a stable power supply where required, and the assets gathered and ready for marking. Idle time caused by assets or access not being ready may be billed.
6.3. Laser marking is permanent. The asset list, wording and serial ranges you approve before marking begins are final.

7. Laser Machine Sales

7.1. Machines are supplied with delivery, installation and free operator training as described in your quotation.
7.2. Warranty terms are stated per machine at the point of sale. Warranty does not cover damage from misuse, unauthorised modification, or operation contrary to training.

8. Payments, Cancellations & Refunds

8.1. Payment methods and any deposit requirements are stated on your quotation. Custom production begins after the agreed payment is received.
8.2. Orders may be cancelled free of charge any time before production begins. Once materials are committed or production has started, costs incurred up to that point are payable.
8.3. Because custom-branded goods cannot be resold, completed custom items are not returnable except under clause 2.3 (our production error).

9. Liability

9.1. Our total liability for any order is limited to the amount paid for that order.
9.2. We are not liable for indirect or consequential loss (lost profits, missed events or campaigns) arising from delays or defects, though we will always work to put things right quickly.

10. Governing Law

10.1. These terms are governed by the laws of the Republic of Kenya. Disputes are first addressed in good faith between the parties; unresolved disputes fall under the jurisdiction of the Kenyan courts.
10.2. Questions about these terms: info@colorshade.co.ke or WhatsApp +254 712 432531.
